Grokster v. MGM: Impact on Technology, IP and Business Practice

Abstract: The US Supreme Court recently handed down its widely anticipated decision in MGM v. Grokster, involving the use of free software to share copyrighted forms of entertainment over the Internet. Although the case focused on file-sharing, it has the potential to expand secondary liability for infringement for a wide variety of technology companies and even their investors. Six of nine members of the Supreme Court also used Grokster as a vehicle for revisiting the landmark Sony-Betamax decision, which held that devices capable of substantial non-infringing uses would not be liable. On its own terms and in its potential impact on the Sony-Betamax decision, Grokster is a very important case for a wide range of technology businesses, including software and device makers, and those advising them.
